SC dismisses petition to disqualify P K Biju

New Delhi: The Supreme Court on Monday dismissed a plea challenging the election of CPM nominee from Alathur Lok Sabha constituency PK Biju. Bench comprising justice JM Panchal, Gyan Sudha Misra, made it clear that the petitioner failed to provide enough evidence to disqualify Biju. Senior advocate Nageswara Rao who presented for petitioner claimed that , Biju cannot declare his mother's caste (Pulaya) as in inter cast marriages, the children will get caste of their father. SC upheld the Kerala High Court consideration of documents which stated that Biju was brought up on Pulaya caste. Court also pointed that petition was not able to prove the difference between Pulaya and Cheramar castes. According to the petitioner, P.A. Sekharan of Palakkad, Biju did not belong to the Schedule Castes and so was not entitled to contest from the reserved constituency. He contended that Biju was a Christian.
