Kochi: Kerala High Court on Friday observed that the state government policy as not to give allottement for more self financing schools, is against public interest. The order was issue by division bench comprising justice CN Ramachandran Nair and Justice P S Gopinathan while issuing order to grant permission for Mattathukad Tribal Mission English Medium School in Attappadi. Mission has been providing free education and accommodation for tribal , and SC/ST kids. HC said denying permission for such a school is against the aim of the free education concept in the constitution which offers free education till the age of 14.
If the government is not able to provide free education for kids from 6 to 14 years of age, the government should give consent to those who can offer the same. The government will never have extra liabilities even if it grants permission for the school . The HC asked it do not under stand why the government blocking an agency which aims to provide free education.
Though the school, which began function from 2001 and applied for recognition in 2003, school administrative secretary K Paulose filed petition when the government denied the same. A memorandum was passed for school in tribal sector in Sholayar grama panchayath and Attappadi block panchayath. On the petition filed by school, court asked the government to consider the giving permission. But government dismissed the plea. Though the school authorities again filed plea against it , the single bench did not gave permission of the same. The present verdict came on the appeal fled against this.
The government stated that allottement of more un aided schools will short the number kids in other schools . Court observed the allegation is not withstanding . There are no such schools near the Tribal missions schools, pointed Adv George Poonthottam who presented for the petitioner.
