    Kerala plea in SC, seeks vacation of stay in Palmolein case

    New Delhi : Kerala today filed a petition in the Supreme Court seeking vacation of its stay against the criminal proceedings in Rs 2.8 crore Palmolein oil import scam in which Central Vigilance Commissioner P J Thomas is also an accused. The apex court had on August 3, 2007, stayed proceedings in the case before a designated CBI court in Kerala.

    Mr Thomas was the Kerala food secretary and later on became the Chief Secretary of the state.

    The main allegations against Mr Thomas was that he allowed the import of the palmolein oil at inflated rates causing a loss of Rs 2.8 crore to the state exchequer.

    Mr K Karunakaran was the then Chief Minister of the state.

    Mr Thomas is also under the CBI scanner for his alleged involvement in 2G Spectrum case which has already rocked and paralysed the functioning of the Parliament.

    According to the state government corruption has no nexus with official discharge of the duty by a public servant and therefore the protection of sanction is not available to a public servant facing allegations of corruption.
