    High Court verdict tomorrow in Kasab case

    The 26/11 case is set for another legal milestone on Monday when the Bombay High Court will deliver its verdict on confirmation of death sentence awarded by a trial court to Mohammad Ajmal Amir Kasab, the lone surviving gunman of the November 26, 2008, Mumbai carnage.

    On May 6, 2010, a special sessions court at Mumbai's high-security Arthur Road jail awarded Kasab death penalty on five counts — murder, abetment to murder, waging a war, criminal conspiracy and committing terror acts.

    The High Court will also give its ruling on the appeals filed by the prosecution against the trial court's acquittal of Fahim Ansari and Sabahuddin Ahmed.

    As per prosecution, the two Indian nationals prepared and conveyed maps of target locations to the Lashkar-e-Taiba.

    Hearing in the confirmation case began on October 18, 2010, after Kasab challenged the lower court order. The proceedings lasted over three months wherein the prosecution presented evidence against Kasab.

    Public Prosecutor Ujjwal Nikam opposed part acceptance of Kasab's confession by the trial court. Either it had to be accepted in its entirety or rejected fully. He sought to corroborate witness testimonies.

    Defence lawyer Amin Solkar sought retrial saying Kasab was denied a fair trial. He claimed that important witnesses were not examined. While he did not deny the incident of 26/11, he raised doubts over witness testimonies.

    A Division Bench of Justices Ranjana Desai and R.V. More heard the confirmation case and arguments. During the course of the hearings, the Bench watched footage of Kasab and his partner Ismail, captured by the CCTV cameras at the Chhatrapati Shivaji Terminus.
