Kochi: The Ernakulam principal sessions Court on Tuesday sought an explanation from CBI over the delay in arresting the higher police officials including an IG involved in the custodial death of Sampath, the prime accused in Puthoor Sheela murder case in Palakkad. The Court has issued a directive for serving a notice to the CBI regarding the same. Sampath's brother Murukesh had filed a petition in the Court seeking an explanation for not arresting the top police officials involved in the case. The petition would again be heard on July 26.
The plea was filed challenging the CBI direction for not arresting ADGP Mohammed Yasin and DIG Vijay Sakhare. The Police had recently arrested Johnson Lobo, a police constable in connection with the case.
Sampath had died in police custody on March 29, 2010.
On Monday too the Ernakulam principal sessions court once again came down heavily at the CBI for not arresting an IG involved in the case saying that the act of CBI questions its credibility. When the CBI had arrested an SI in relation to the custody death of Sampath, the prime accused in Puthoor Shiela murder case, why is the CBI reluctant to arrest an IG? the court asked. The court said this while granting bail to an accused SI Ramesh.
The post-mortem report stated that Sampath died due to internal bleeding in the brain. Earlier, the CBI had filed a charge sheet against SI Ramesh and two other policemen. The CBI had implicated IG B S Muhammed Yasin and SP Vijay Sakhare in the Sampath custodial murder case too. While Vijay Sakhare has been named as the 15th accused, Mohammed Yasin is the 16th accused. As per the witness, when Sampath was under custody the IG kicked Sampath in his stomach and his head hit a wall. The court wanted to know why ADGP Mohammed Yasin, who has been named as an accused in the case, was not arrested? Admonishing the CBI for returning the arrest warrant issued by the court, session's judge Kamal Pasha said the investigating agency should not show double standards.
The Court, while hearing the case, said there are no evidences to prove that the SI had directly injuried Sampath. In the sessions court Ramesh questioned the order of CJM court, which denied him bail. The Court also ruled out CBI's claim that if given bail Ramesh would tamper with the evidence. The Court felt that Ramesh is under suspension now with no particular charge of any station or office. But at the same time the big guns like IG (current ADGP) and SP (current DIG) are walking free, judge B Kamal Pasha said.
