DMK MP Kanimozhi’s expectations to smell fresh air of freedom after spending almost four months in Tihar jail via a bail plea on Friday were grounded by a city court as it deferred the matter till October 1.
Kanimozhi was visibly upset over the decision as a morose look passed her face after pronouncement of the same. This was DMK patriarch M Karunanidhi’s daughter second attempt to get the relief.
Lodged in Tihar jail since May 20 following rejection of her bail plea by Special judge OP Saini, Kanimozhi approached his court for bail, a day after the court failed to adhere to its self-imposed deadline of September 15 for framing of charges in the 2G scam case.
The 43-year-old Kanimozhi sought bail on account of her being a woman MP and the mother of a school-going child who needs to be taken care of. Co-accused Sharad Kumar, director of Kalaignar TV also moved a bail application on Friday.
The moment the duo were to file their bail application before the court, Public Prosecutor AK Singh, in a lighter tone suggested the defence counsels to file the bail pleas later saying, “The facts will change after the framing of charges then the facts in your bail plea will have to be changed too. And who knows they (Kanimozhi and Sharad Kumar) might be discharged after the framing of charges.”
Kanimozhi in her application told the court that neither she nor DMK-run Kalaignar TV received spectrum licence and that she was not the beneficiary of the ‘loan transaction of Rs 200 crore in the 2G scam either.
“Prosecution documents themselves would show that she (Kanimozhi) had no role in its (Kalaignar TV) operations and the management of the offices of the said TV and particularly in relation to the transfer of funds of Rs 200 crore to Kalaignar TV Pvt Ltd nor its subsequent re-payment,” said Kanimozhi’s bail plea filed by her counsel VG Pragasam and SJ Aristotle. Kanimozhi, along with Kumar, is accused of taking a bribe of `200 crore which had been routed to Kalaignar TV, in which she has 20 per cent stake.
“Kanimozhi and Sharad Kumar are innocent and sought to be falsely implicated in the present case due to biased media reporting and on the basis of conjectures and surmises,” said the bail plea.
Kanimozhi also said in her plea that as a Member of Parliament and whip of DMK Party in Rajya Sabha, she has to attend Parliament sessions and all-party meetings convened from time to time in connection with parliamentary business.
Kumar, on the other hand, in his bail plea, denied having any link with former Telecom Minister A Raja, the key accused in the case. “Conspiracy with him (Raja) is denied as totally false, baseless and malicious. Kumar is a professional and not even a DMK party member,” the bail application filed on behalf of Kumar said adding he is only a director in the TV channel and not its CEO or managing director and holds 20 per cent stake in it.
While refusing bail to various 2G scam accused, the Supreme Court had earlier asked them to move the trial court for bail after framing of charges in the case.
