A city court on Monday deferred the bail pleas of five accused in the 2G spectrum allocation case, including former Telecom Minister A Raja's private secretary, RK Chandolia and Swan Telecom promoter, Shahid Usman Balwa, till it pronounces order on framing of charges.
Special CBI Judge O P Saini deferred till October 17 the bail pleas of three accused — Kusegaon Fruits and Vegetables pvt ltd directors Asif Balwa and Rajeev Aggarwal and Cineyug Films pvt ltd director Karim Morani — while the pleas of Chandolia and Balwa were pushed back for hearing on October 18. The judge deferred the hearing saying he would like to hear their bail pleas after the framing of charges which he has tentatively slated for October 15.
The court explained the decision saying that if it began deciding bail pleas at this juncture, it would not be able to decide on framing of charges in the case in time as it had to examine voluminous documents and materials.
"If you keep on moving applications in between and advancing arguments on them, when would I have the time to complete the order on charge? Right now I do not have time to hear arguments on bail pleas ," the judge said. CBI Prosecutor AK Singh added that if the accused had not brought the issue of Law Ministry and TRAI report in between, the order on framing of charges would have been pronounced on September 15 itself.
