CBI opposes Chandolia bail
The bail application of RK Chandolia, former private secretary to former Telecom Minister A Raja, on Wednesday was opposed by the CBI who told a special CBI court that Chandolia is a public servant and cannot be treated on par with those granted bail in the 2G case.
The defence counsel however, objected to the argument and argued that DMK MP B Kanimozhi who got bail on Monday from the Delhi High Court was also a public servant.
Special CBI Prosecutor UU Lalit countered, saying charges against Kanimozhi are in relation to routing of Rs200 crore from DB Group to DMK-run Kalaignar TV whereas “the action committed by these three persons (Raja, Behura and Chandolia) were in the capacity of public servant.” Special CBI Judge OP Saini has now reserved the order for Chandolia’s bail plea for Thursday.
Lalit said, “The core sector of conspiracy comprises these three gentlemen (Raja, Behura and Chandolia) and they fall in the same category which is different from others who are granted bail. These three gentlemen (Raja, Behura and Chandolia) are on a different footing. It will be unrealistic to draw parity with those released on bail.”
Chandolia’s counsel Vijay Aggarwal said, “Charges levelled against Behura and Raja are much more serious than charges against Chandolia. Chandolia is conspicuously absent from the charge of 409 (which carries a maximum punishment).”
He added that his client has been in jail for over 10 months but the alleged beneficiaries of the case have been granted bail. Barring Raja, Behura and Chandolia, all the accused individuals in the case are now out on bail.
Behura’s bail plea is pending before the Delhi High Court while Raja has not yet moved any bail application since his arrest on February 2 this year along with Behura and Chandolia.
