    Murder accused found 'whimpering'


    A man accused of stabbing a soldier to death in Renfrewshire was found "whimpering" by police who detained him, a court has heard.Det Sgt James Mimnagh told the High Court in Glasgow that Barry McGrory was found at a property in Johnstone the day after Scots Guard Paul McGee died.

    Mr McGrory, 28, denies murdering 28-year-old Mr McGee in Lochwinnoch on 25 October last year.

    He has lodged a special defence incriminating co-accused, Ian Wallace.

    Det Sgt Mimnagh told the court how police received information that Mr McGrory was at a house in Rankine Place, Johnstone, Renfrewshire, on 26 October 2009.

    He said: "He [Mr McGrory] appeared to be whimpering, that was almost as soon as we laid hands on him at the beginning.

    "We asked him did he understand [what was happening] but he made no comment. He was put in the rear of a vehicle and he was taken to the police station."

    Knife sheath

    Mr McGrory is charged with repeatedly stabbing Guardsman McGee outside the family home in McConnell Road, Lochwinnoch.

    The trial also heard that a brown knife sheath was discovered by police lying in the driveway of the property.

    Mr McGrory and Mr Wallace are also charged with stealing a handbag and its contents.

    It is claimed they later attempted to defeat the ends of justice by disposing of a knife, removing blood stained clothes and washing themselves to remove any blood marks.

    Mr Wallace is also charged with assaulting the soldier, his mum Anne McGee, her friend Ann Laycock and taxi driver John Banach.
