    Emanuel kicked off Chicago ballot

    24 January 2011 Last updated at 13:52 ET A US appeals court has ruled that President Barack Obama's former chief-of-staff, Rahm Emanuel, cannot run to be mayor of Chicago.

    Judges in Illinois voted 2-1 to overturn a ruling to keep Mr Emanuel's name on the ballot, which will take place in less than a month.

    Those challenging Mr Emanuel's election bid claimed he did not meet a residency requirement.

    Mr Emanuel quit his White House job in October last year.

    On Monday, an Illinois appeals court ruled that Mr Emanuel's name could not appear on the ballot to replace mayor Richard M Daley because he did not live in Chicago in the year before the election.

    "We conclude that the candidate neither meets the municipal code's requirement that he have resided in Chicago for the year preceding the election in which he seeks to participate nor falls within any exception to the requirement," the appeals court said, in a split ruling by three judges.

    Mr Emanuel has said he always intended to return to Chicago and was only living in Washington at the request of the president.

    The decision is likely to be challenged in a higher court.
