Thiruvananthapuram: Apart from suspending the reinstated daily draw of lotteries in the state, the Chief Minister V S Achuthanandan directed to withdraw the appeal filed in the Supreme Court against HC division beach order permitting the other state lotteries to function here. The appeal was earlier field as per the direction of high level meeting lead by CM himself. After withdrawing the appeal CM is planning to file a review petition in HC itself. But the finance department is of the stand that they would withdraw the same only after receiving written consent from CM. As the department had not received any such order till Wednesday evening. On the other day, CM suspended the daily draw so as to not to affect the appeal in SC. He took that decision as per legal advice which leads to a clash of opinion in CPM too. As party state committee member MV Jayarajan protested against the same. Though CM directed to withdraw appeal it is not clear that whether the suspended daily draw would be reinstated again.
CM directed to withdraw the appeal to state government standing council PV Dinesen. To receive the order on the same standing council contacted principal secretary in finance department. But Dr Thomas Isaac gave instruction to issue order only on receiving CM's direction in writing.
Earlier HC division bench issued an order to accept advance tax from Megha distributors and allowed them to conduct draw in more than one time. The order allows other state lotteries to function in the state. During that time a high level committee lead by CM decided to appeal against the same and the fianc ministry filed appeal in SC.
CM said so on getting a legal advice that filing review petition would be more beneficial. Megha distributors filed fake documents in HC and review petition would be submitted pointing the same. When decided to file appeal, CM had not received the details on the same. Later CM collected the original copies of documents, which were altered by Megha to submit in HC, from Bhutan. Police took case against Megha owners John Kennedy for submitting fake documents. Pointing all these, review petition would be submitted.
