Palakkad custody death: SC stays HC order

New Delhi: The Supreme Court on Wednesday stayed the HC order on Palakkad Puthoor Custodial murder case. The bench, comprising justices Dalveer Bhandari and Deepak Varma, while hearing the special petition filed by the CBI seeking to exclude some statements in HC order, wanted to send notices to all parties associated in the case. On January 24, the HC had ordered that if higher officials are trying to influence the Puthoor case, it would be considered contempt of court and even the CBI head may be called for an explanation. The HC also directed to the investigation officer to submit the charge sheet without the intervention of higher officers.

Solicitor general Gopal Subramanian, who was present for the CBI, stated that the HC order looks strange. The order is against the internal rules of CBI. The stay was sought for the order which stated that the chargesheet should not be shown to the higher officers and give protection to the investigation officers by 6 CRPF men.

The HC made the remarks after examining the case diary and finding that the higher officials had intervened when a investigation officer had attempted to include two IPS officers in the accused list.
