The Kerala High Court on Friday demanded an explanation from the State Government for dissolving the MA Nissar Judicial Commission appointed to probe the clashes and police firing at Kasaragod on November 15, 2009 in which a Muslim League activist and a Muslim youth were killed.
The Government is now required to explain the reasons behind its decision to dissolve the commission after giving it an extension by six months. Admitting a petition challenging the dissolution of the panel, the court also ordered issuance of notices to the Government, Director General of Police and the now-disbanded Nissar Commission.
Petitioner Narayanan of the Lawyer’s Union said that the commission was said to have received path-breaking evidences during the extension given to it. Three important affidavits had been submitted to the commission during that period. The Congress-led UDF Government had on June 23 gave a six-month extension to the panel but dissolved it a month later.
The Government’s decision to disband the commission just when its probe was entering a crucial phase had strengthened the suspicion that it was determined to derail the probe because of reports that the clashes at Kasaragod and the police firing necessitated by it were the result of a Muslim League conspiracy to foment communal riots across the Malabar region.
DySP MJ Sojan of the Crime Branch, Ramdas Pothen, then SP of Kasaragod who opened fire at the rioters, and DySP KV Raghuraman had told the Nissar Commission that they had got evidences to prove that the riots were the result of a Muslim League conspiracy to foment communal riots.
