Muneer Deshmukh was not a member of Students Islamic Movement of India (SIMI), as he was acquitted from the charges under Unlawful Activities Act.
However, the district court found him guilty under two sections of the IPC and sentenced him to three years imprisonment in two different cases under the IPC. A fine of `50,000 was also imposed on him.
First Class Judicial Magistrate (JMFC) Gangacharan Dubey had granted bail to Deshmukh on July 14, in this same case.
Additional Chief Judicial Magistrate (ACJM) RP Sonkar on Saturday announced judgement in the case registered against Muneer at the Habibganj police station.
Commenting after the judgement, defence lawyer Parvez Alam said that the court had sentenced the accused to imprisonment under Section 153 (B), and 295 (A) of the IPC but the court had acquitted Muneer in the case which was registered under Section 10 and 13 of the Unlawful Activities Act.
"The court has also directed the DGP to take action against the authority responsible for the missing original case diary and the related documents of the case in the next six months," Alam said.
Three cases were registered against Muneer in the three police stations of State capital.
In one of the cases registered against him at Shahjehanabad police station, he had been sentenced to three years' imprisonment earlier, while two other cases were registered at the Habibganj and Talaiya police stations. The decision in Talaiya case is still pending in the court.
The case of Muneer Deshmukh was transferred from the court of First Class Judicial Magistrate to Additional Judicial Magistrate (ACJM) on July 19.
On the request of the prosecution, Chief Judicial Magistrate (CJM) RG Singh had issued orders in this regard.
JMFC Gangacharan Dubey had granted bail to Deshmukh on July 14. Since, the police had failed in producing the witnesses in time before the court, it was decided to release him on bail after which the role of prosecution had come into controversy.
However, he continued in the jail in connection with other cases registered against him.
