The bail petitions moved by Subhashree Panda alias Mili Panda's advocate P Brahmananda Patnaik on Friday before the Rayagada Additional District Judge(ADJ) was rejected under the ground that, the petition moved under sections 439 of CrPC is not maintainable and the petition filed under Section 437 will be heard on Monday, sources said.
Sources reveal that on October 21, a Gunupur court had send Mili Panda to judicial custody till October 25 after being get freed from the Orissa High Court. Her advocate Patnaik moved her bail petition on October 24 before the Gunupur SDJM Court which was rejected and the court committed the case and send details of the case record to ADJ, Rayagada. On October 25 two bail petitions were filed by the advocate before the ADJ, First Track Court at Gunupur praying that the bail may be granted on production of copies of the case record available with Mili Panda or the court may get the case records from Rayagada court by a special messenger for which the cost shall be borne by the petitioner. As the petitions are not maintainable, the Gunupur ADJ rejected both the petitions moved by the advocate of Mili.
Accordingly bail petitions under Sections 437 and 439 of CrPC were filed before the Rayagada ADJ on the day. The court heard the petitions and rejected the petition filed under Section 439 as that relates to appeal provisions and not maintainable. The petition moved under Section 437 will be heard on October 31, the court orders revealed.
Sources said a case was lodged against Mili Panda under Sections 147,148,149,307 of IPC and 25 A of Arms act in Gudari police station in Rayagada district during 2003 and there was an exchange of fire between the police and Maoists.
Mili Panda was the accused in the case as she was present during the incident and managed to escape for which the case was initiated against her.
