Krishna moves Karnataka HC
A day after an FIR was filed against Foreign Minister SM Krishna by the Lokayukta court based on a private complaint alleging his involvement in illegal mining when he was the Chief Minister of Karnataka, he moved the Karnataka High Court on Friday seeking a stay on the proceedings.
According to his lawyer Ashok Haranahalli, Krishna in his petition has claimed that he had not committed any irregularities or illegality in the mining sector when he was the CM.
An FIR was filed against Krishna under various sections of the Prevention of Corruption Act, Forest Conservation Act, Forest Act and Minerals and Metals Regulation and Development Act (MMRDA) and IPC sections following a direction by the Lokayukta court to investigate the complaint by TJ Abraham, a city-based social activist and businessman. Lokayukta Judge NK Sudhindra Rao had on December 3 admitted Abraham’s complaint and directed the Lokayukta police to file its investigation report by January 6.
In another development, the ruling BJP continued its war against Governor HR Bhardwaj who is accused of stalling the appointment of Lokayukta recommended by the Cabinet.
In fact, former Chief Minister BS Yeddyurappa who has suddenly become active, has demanded the Governor’s recall as he has violated all his constitutional obligations. Talking to The Pioneer, the BJP strongman has said the Governor must approve the name of Justice SR Bannurmath for the post of Lokayukta as recommended by the Cabinet or quit the post.
Yeddyurappa who has been circulating a note in the ongoing winter session of the Assembly is taking all his legislators to Delhi to parade before the President demanding the recall of Governor Bhardwaj.
In a six-page strongly-worded note circulated to his party MLAs in order to “prepare them” to take the fight against the Governor to its logical end, Yeddyurappa said Bhardwaj, as Union Law Minister between May 2002 and May 2009, had recommended Justice Bannurmath to the collegium for appointment as Chief Justice of Kerala High Court.
Yeddyurappa averred that Justice Bannurmath, as Kerala HC CJ, had posted details of his assets and liabilities online, thus becoming worthy of emulation for others on transparency.
According to a close aide of Yeddyurappa this was an opportunity to show his strength to his party seniors who have done injustice to him by asking him to step-down as Chief Minister. Yeddyurappa who still nurtures a hurt feeling against his party seniors for letting him down has ruled out joining any party and wants to bring back the image of the party which has suffered in the onslaught of mining dust.
He said, “I am hurt by what has happened. I have built the party here. I will not leave the party at any cost. I am going to rebuild the image of the party. All of them are exposed (talking about FIR against three former CMs, which include SM Krishna, Dharma Singh and HD Kumaraswamy). We need to build the image of the State. I am the one who banned the illegal mining in the State and I have become a victim of a conspiracy.”
