Man convicted for murdering sister-in-law
An Old Delhi resident has been convicted on murder charges on the basis of the statements of his own family members by a city court.
The statements of the accused person's wife, daughter and brother led to his conviction. Additional Sessions Judge Narinder Kumar sentenced Pradeep Shah to life imprisonment for killing his sister-in law with a grinding stone for supporting his wife.
Shah, a spice vendor and resident of Railway colony, was held guilty of killing Gauri by hitting her head with a grinding stone. Gauri was the elder sister of Shah's wife, Kalpana, and was also married to the accused's brother, Raj Kumar. While convicting Shah, the court said that the motive behind Gauri's muder was Pradeep's unacceptance of Gauri supporting his wife when they had heated arguments. The court said, “It goes to show that the accused used to suspect that Gauri was supporting his wife, whenever, there were even minor scuffles between the couple.” The court also imposed a fine of Rs 5,000 on him.
Shah's daughter Sangeeta, wife Kalpana and brother Kumar all deposed against Shah in the case. The court, while holding Shah guilty of the crime, said: “Family members of the accused have come forward and deposed against him. There is no explanation from the accused's side as to why his family members have deposed against him. The court also does not see any reason for their having substituted real culprit of Gauri with the accused.”
The court further observed that the family members would be the last person to substitute the real culprit or to falsely implicate their own. ASJ Kumar said, “There is nothing on record to suggest that Kalpana would depose against her husband. There is also no material on record to suggest as to why Sangita would depose against her father.”
The murder dates back to the intervening night of May 30-31, 2008, when an inebriated Shah reached home and found his jhuggi's door locked from inside. As his wife was asleep inside, she failed to respond to his knocks on the door. Shah left his home only to return later. Shah then started hurling abuses at Kalpana and Gauri. Gauri was sleeping outside the jhuggi with Shah's daughter Sangeeta. Agitated by Kalpana not opening the door, Shah hit Gauri's head with a grinding stone. Gauri was rushed to a nearby hospital but was declared brought dead.
