SC verdict today on plea challenging PM inaction
The Supreme Court will on Tuesday deliver judgment in a case related to the 2G spectrum scam, filed by Janata Party president Subramanian Swamy against Prime Minister Manmohan Singh for the delay in taking decision on granting sanction to prosecute jailed former telecom minister A Raja.
The judgments on other three cases including the demand for a CBI probe into the role of Home Minister P Chidambaram in the 2G Scam and cancellation of licenses issued by Raja are expected to come before any day by February 2, the day AK Ganguly, one of the two judges of the bench retires.
The bench comprising Justice GS Singhvi and Justice AK Ganguly had reserved the judgment in Swamy’s case against Manmohan Singh in January, last year, stating that the judgment would focus on the guidelines for sanction for prosecution in future.
Swamy had, on September 2010, approached the apex court against the Prime Minister for not taking a decision on his petition for granting prosecution sanction against Raja for his role in spectrum allocation. The case, which almost became infructuous after Raja’s resignation, got momentum when the Judges expressed displeasure over the two-year-long delay by the PMO on Swamy’s petition.
After the court sent notice to the PMO, Swamy made a u-turn. Giving a clean chit to Manmohan Singh, he put the blame on top officials of the PMO and Law Ministry for “misleading” the PM.
