Latest National News : HC dismisses plea to re-probe Pandya murder
The Gujarat High Court on Monday dismissed a petition seeking fresh probe into the 2003 murder of former Minister of State for Home Haren Pandya. Pandya was shot dead outside the Law Garden on March 26, 2003 to avenge his alleged role in the 2002 post-Godhra riots.
The petition was filed by Pandya’s widow Jagrutiben following a Division Bench of the High Court last year reducing the sentences of the 12 convicted by a POTA court earlier in 2007.
The designated POTA Court had sentenced nine of the 12 convicts to life imprisonment while two others were sentenced to rigorous imprisonment for seven years. One co-conspirator was sentenced to five-year jail term.
The ruling of the Division Bench of the High Court had criticised the Central Bureau of Investigation (CBI) for their faulty probe into the former Minister’s murder, following which Pandya’s widow had filed the petition seeking re-investigation to find out the real culprits responsible for her husband’s murder.
The Gujarat Government and the CBI have since moved the Supreme Court challenging the High Court ruling. Justice Anant S Dave of the High Court dismissed the petition as appeals of the State Government and the CBI are pending before the apex court.
CBI counsel Yogesh Ravani opposed the petition of Jagrutiben Pandya on the ground that the country’s apex court is seized of the matter.
