Fresh trouble for BSY as SC orders probe

Fresh trouble for BSY as SC orders probe
The order of the special forest bench of the Supreme Court headed by Chief Justice SH Kapadia on Friday asked the Central Empowered Committee to investigate bribe charges against former Chief Minister and BJP strongman in Karnataka BS Yeddyurappa on illegal mining case. Allegations that bribe was paid to Yeddyurappa have not only stirred the State BJP but also shaken the groups within.

An insider in the ruling party told The Pioneer that the decision of the SC asking CEC to probe was a blow to the former Chief Minister and has further dented the image of the party in Karnataka. He said “it was not at all anticipated. It is a jolt to Yeddyurappa and also it affects the stability of Sadananda Gowda Government.”

Even though the former Chief Minister has closeted with his supporters in dealing with the possible implications of the CEC giving a negative report, a close aide of Yeddyurappa revealed that his leader was ready for a legal battle.

Another party functionary felt that in a way the SC upholding the illegal mining report submitted by former Karnataka Lokayukta Justice Santosh Hegde has created a political storm in the State. He (Hegde) has directly implicated the former Chief Minister. “We are keeping our fingers crossed. If he is implicated it will further affect the BJP,” he asserted.

In another embarrassment to Sadananda Gowda, the Chief Justice of Karnataka High Court has asked the State Government to revoke the controversial appointment of Justice Chandrashekharaiah as Upalokayukta by the Chief Minister recently. In a strongly worded seven-page letter, Justice Vikramajit Sen stated that the appointment of Chandrashekharaiah as Upalokayukta did not conform to constitutional provisions and therefore has no legal efficacy. He also told the Government he did not recommend his name for the post as required.

Even though the fire fighting has started, so far the Government is unable to secure the resignation of Justice Chandrashekharaiah, who has refused to quit. According to a Government source, a senior Minister

met Justice Chandrashekharaiah asking him to quit, but the Upalokayukta refused to budge.

Justice Chandrashekharaiah has told the media that it was in total ignorance of law. He also refused to quit and shot back saying “Why should I? I am not party to this. If only the Chief Justice’s words were to prevail where is the need for consulting other members?” He further said “it was the Chief Minister who exercised his prerogative and the Governor has approved the appointment. What is wrong in it?”

Meanwhile, the Government wrote to the Governor seeking his intervention for a suitable action which was negated by the Governor. However, a Government source told The Pioneer that there were continued efforts to seek his resignation to prevent further damage to the Government.
