    Next hearing in Nupur’s trial on May 9

    The trial of Nupur Talwar in the Aarushi murder case could not be initiated in the CBI magistrate court on Thursday after her lawyers cited lack of complete documents. The next hearing is on May 9.

    After her application, CBI special magistrate Preety Singh fixed May 9 as the date for the next hearing of the case for committal. Earlier, the sessions court of special CBI Judge S Lal rejected the bail application of Dr Nupur Talwar. While passing order to reject the bail, the special CBI judge S Lal observed: “I am not inclined to exercise the discretion in favour of the accused applicant to grant bail. Ex-consequentia, the application for the bail is rejected.”

    Mentioning the details of arguments, the CBI judge stated that the defence counsel submitted that the applicant is completely innocent, closure report had already been submitted and there is no iota of evidence. But despite that, she has been erroneously summoned by the magistrate to stand trial.

    She had been evading appearance before the court. She might hamper the expeditious trial directed by the Supreme Court of India if bail is given. She may flee from justice and create hindrance. “She is also accused of obliterating evidence of commission of offence in the twin murder. At this stage, it will not be proper to advert to the merit of the case. There is prima facie evidence to suggest the involvement of the accused,” added the special CBI judge S Lal in his order.

    Opposing Nupur Talwar’s lawyer’s bail pleas, CBI counsel RK Saini submitted that the Talwar couple have tampered with evidence. They had heavily dressed up the crime scene. Nupur’s lawyer was trying to emotionally mislead the court and the direction of Supreme Court for expeditiously hearing the bail was binding on the magistrate court, not on this session court.
