Nod for review petition on ambulance procurement
The Supreme Court on Monday gave permission to NGO Ambulance Access Foundation to file a review petition after the latter had raised doubts on how a Government law officer appeared without instruction from the concerned Ministry on the crucial date when the matter was disposed.
Under RTI, the petitioner procured information from the Health Ministry and the Law Ministry which suggested that the Centre was agreeable to framing guidelines for procurement of ambulances by States.
But on November 18, 2010 when the matter was heard and disposed by court, two law officers ASG Mohan Parasaran and senior advocate TS Doabia appeared for the Health Ministry and presented varying stands leading the court to drop framing of guidelines. Information under RTI revealed that the Health Ministry supported guidelines giving rise to suspicion as on what basis ASG Parasaran opposed the petition.
The bench of Justices AK Patnaik and Swatanter Kumar felt that the application for modification was not maintainable.
Instead, it directed advocate Anirudha Rajput to file a review petition.
