Apex court no to IM man’s deportation
The Supreme Court on Monday refused to direct deportation of alleged Indian Mujaheedin operative Fasih Mohammad following efforts by his wife to approach the court claiming that her husband was illegally detained by Indian sleuths at Saudi Arabia.
The Centre, represented by Additional Solicitor General (ASG) Gourab Banerjee informed a bench headed by Justice P Sathasivam that the Indian authorities were in touch with their Saudi counterparts to hand over the custody of Fasih, who is equally wanted in terror attack cases in the country.
Moreover, since the Saudi authorities had arrested Fasih in connection with a terror offence, there was nothing that the Indian Government could do but wait for the diplomatic process to take its own pace. Banerjee informed the court that even in the case of LeT operative Sayed Zabiuddin Ansari alias Abu Jundal who was arrested from Saudi Arabia in connection with the Mumbai 26/11 terror attacks, the Saudi agencies did not hand over possession for 16 days.
The bench while disposing the matter said, “We are convinced on the basis of the correspondences (produced by Centre) that the Government has taken steps. We cannot direct the Saudi Arabia Government in this regard.
