Prajapati encounter hearing adjourned
A local court in Danta of Banaskantha district in north Gujarat on Monday adjourned its hearing on the chargesheet filed by the CBI in connection to the alleged fake encounter killing of Tulsiram Prajapati in December 2006.
The proceedings in the case have been adjourned till September 15 after the chargesheet was registered on Monday.
The CBI chargesheet filed in the Danta court last week had named Gujarat's former Minister of State for Home Amit Shah and several senior police officers, including retired DGPs — PC Pande and OP Mathur, Additional DGP Geetha Johri and suspended IPS officers DG Vanzara and RK Pandian.
Of the total 20 accused, many have been charged with murder, criminal conspiracy and destruction of evidence under various clauses of the arms Act.
Tulsiram Prajapati, an accomplice of slain extortionist Sohrabuddin Sheikh, was killed in an encounter at Chhapri village in Danta taluka of Banaskantha district on December 28, 2006, allegedly because he was an eyewitness to Sheikh’s abduction the previous year.
The Supreme Court ordered a CBI investigation into the killing following Prajapati’s mother Narmadaben’s allegations that the encounter was fake.
Ordering registration of the chargesheet, the Danta court rejected the objections of the accused, Pandian, and others over the jurisdiction of the CBI to file the chargesheet in the local court.
The counsel of the accused argued that all charge-sheets of the cases handled by CBI are filed in the special court in Ahmedabad. The objection stated that the chargesheet should be filed in the Special CBI Court in Ahmedabad instead of the local court at Danta.
