SC to review verdict on CIC
In a significant decision, the Supreme Court on Tuesday decided to review its September 13 decision reserving top posts in the Central Information Commission (CIC) and its counterpart in States for judges. Admitting a review petition filed by Union of India, the Bench of Justices AK Patnaik and Swatanter Kumar, found substance to hear the Centre after the petition raised concerns over the “non-practicability” of Court order threatening to derail the smooth functioning of the RTI-implementing agencies. The court decided to hear the petition in open court giving opportunity to the Centre to argue its case and point out that even Information Commissioners need not be judicial or legal members as the work performed by CIC was not “judicial” in nature.
